1. Overview
Hudson Valley DFY Marketing ("Hudson Valley DFY Marketing," "we," "us," or "our") provides done-for-you digital marketing services — including AI Visibility (AEO and GEO), Google Business Profile management, website design and hosting, local SEO, social media management, review generation and reputation management, business citations, press releases, and direct mail campaigns — to local businesses in the Hudson Valley, New York region and beyond.
This Privacy Policy applies to visitors of hudsonvalleydfymarketing.com and any linked landing pages or audit tools (collectively, the "Site"), to individuals who submit an inquiry or request a free audit, and to businesses and individuals who engage us as clients ("Clients," "you," "your"). By using the Site or engaging our services, you agree to the collection and use of information as described in this Privacy Policy.
If you do not agree with this Privacy Policy, please do not use the Site or provide us with personal information.
2. Information We Collect
Information You Provide to Us
- Contact and inquiry information: name, business name, email address, phone number, mailing address, and website URL submitted through contact forms, audit requests, or the RevLeaks audit tool.
- Client onboarding information: business details, service preferences, marketing goals, and any content, images, or materials you provide for use in your campaigns.
- Account access: where necessary to perform contracted services, administrative or manager-level access to accounts such as your Google Business Profile, social media accounts (Facebook, Instagram, etc.), website hosting or content management system, and review platforms. We do not request or store master account passwords where a platform's own delegated-access or manager-invite feature is available; where credentials must be shared directly, they are stored securely and used solely to perform the contracted services.
- Billing information: billing contact details and payment information processed through a third-party payment processor. We do not directly store full credit card or bank account numbers on our own systems.
- Communications: records of emails, calls, texts, and meeting notes related to your inquiry or engagement.
Information Collected Automatically
- IP address, browser type and version, device type, operating system, and general geographic location (city/region level).
- Pages visited, time spent on pages, referring website, and clickstream data, collected through cookies, pixels, and similar tracking technologies (see Section 5, Cookies & Tracking).
Information From Third Parties
When we manage a Client's Google Business Profile, social media accounts, review platforms, or website analytics, we receive performance and engagement data directly from those platforms (for example, rankings, impressions, clicks, calls, review counts, and engagement metrics) in order to report results and deliver services.
3. How We Use Information
We use the information described above to:
- Respond to inquiries, provide free audits, and follow up on leads;
- Onboard, manage, and deliver contracted marketing services to Clients;
- Access and manage Client accounts on third-party platforms as authorized under our engagement;
- Process payments and manage billing;
- Prepare monthly reports and communicate results;
- Improve the Site, our services, and our marketing;
- Send service-related updates, and — where you have opted in or an existing business relationship permits — occasional marketing communications, which you may opt out of at any time;
- Comply with legal obligations, enforce our agreements, and protect our rights and the rights of our Clients.
4. How We Share Information
We do not sell, rent, or trade your personal information. We share information only in the following circumstances:
- Service providers: hosting providers (such as our website platform), payment processors, email and communication tools, scheduling software, analytics providers, and other vendors who perform services on our behalf and are contractually obligated to protect your information and use it only for the purposes we specify.
- Platform providers: to deliver services, we interact directly with platforms such as Google, Meta (Facebook/Instagram), review sites, and AI search tools on your behalf. Information submitted or generated through those platforms is also subject to that platform's own privacy policy.
- Legal requirements: where required to comply with a subpoena, court order, or other legal process, or to protect the rights, property, or safety of Hudson Valley DFY Marketing, our Clients, or others.
- Business transfers: in connection with a merger, acquisition, or sale of business assets, in which case we will require the successor to honor the commitments made in this Privacy Policy.
- With your consent: for any other purpose disclosed to you at the time information is collected, or with your consent.
5. Cookies & Tracking Technologies
The Site uses cookies, pixels, and similar technologies to operate correctly, remember preferences, and understand how visitors use the Site. This may include analytics tools (such as Google Analytics) and advertising pixels (such as Meta Pixel or Google Ads tags) used to measure the performance of our own marketing and, where applicable, a Client's marketing campaigns.
Most browsers allow you to control cookies through their settings, including blocking or deleting them. Blocking certain cookies may affect the functionality of the Site. Where required by law, we will present a cookie or consent notice and honor your choices.
6. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including for the duration of any Client engagement and for a reasonable period afterward to comply with legal, tax, accounting, and recordkeeping obligations, resolve disputes, and enforce our agreements. Lead and inquiry information that does not convert to a Client engagement is retained for a reasonable period for follow-up purposes and may be deleted upon request.
7. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, alteration, or disclosure, consistent with applicable New York data security requirements, including the New York SHIELD Act. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify affected individuals as required by applicable law.
8. Your Privacy Rights
Depending on your location, you may have the right to request access to, correction of, or deletion of the personal information we hold about you, to object to or restrict certain processing, or to withdraw consent where processing is based on consent. To exercise any of these rights, contact us using the information in Section 13. We will respond within a reasonable time and may need to verify your identity before processing your request. Some information may be retained where necessary for legal, contractual, or legitimate business recordkeeping purposes.
9. California Privacy Rights (CCPA/CPRA)
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, may give you additional rights, including the right to know what personal information we have collected about you, the right to request deletion, the right to correct inaccurate information, and the right to opt out of the "sale" or "sharing" of personal information (we do not sell or share personal information for cross-context behavioral advertising in the manner the CCPA/CPRA defines that term). To exercise any California privacy right, contact us using the information in Section 13.
10. Children's Privacy
The Site and our services are directed at businesses and business owners and are not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we learn we have collected personal information from a child, we will delete it promptly.
11. Third-Party Links & Services
The Site and our services may link to or integrate with third-party websites and platforms, including Google, Meta, review sites, our audit tool provider (RevLeaks), and our hosting platform. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policy of any third-party site or platform you interact with.
12. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. The "Last Updated" date at the top of this page reflects the most recent revision. Material changes will be reflected by an updated effective date, and, where appropriate, we will provide additional notice to active Clients.
